1. Who We Are
Frank Segers publishes the memoir Not Yet via the gateway website at notyetmemoir.com and the reading platform (currently Patreon). For the purposes of the EU and UK General Data Protection Regulation (GDPR), Frank Segers is the data controller, operating under the governing laws of the Republic of Panama. There is no company; the memoir is published in his own name.

2. What Data We Collect and Why
2.1 Data You Provide
Email address: collected when you subscribe to the newsletter or a paid subscription, or submit the Notify Me form. Used to deliver content, episode notifications, and occasional updates.
Payment information: collected by our Merchant of Record (currently Patreon) on behalf of the Author. The Author does not store your card number, bank details, or payment credentials. The Merchant of Record's privacy policy applies to all payment data.
Name (optional): if you choose to provide it when subscribing.
2.2 Data Collected Automatically
IP address and browser metadata: collected by the website hosting provider (Hostinger) and the reading platform (currently Patreon) as part of normal web server operation, disclosed as required under GDPR Art. 13.
Cookies: notyetmemoir.com may use essential cookies required for site functionality. The reading platform (currently Patreon) uses cookies for member sessions. Non-essential analytics or advertising cookies are not used by the Author.
3. Legal Basis for Processing (GDPR)
Contract performance (Art. 6(1)(b)): processing your email to deliver your subscription and episodes you have paid for.
Consent (Art. 6(1)(a)): sending newsletter updates and promotional emails. You may withdraw consent at any time.
Legitimate interests (Art. 6(1)(f)): basic website security and fraud prevention.
Legal obligation (Art. 6(1)(c)): retaining financial records as required by applicable tax law.
4. How Long We Keep Your Data
Subscriber email addresses: retained for the duration of your subscription plus 12 months after cancellation.
Payment records: retained for 7 years as required by applicable tax regulations.
Content advisory acknowledgements: retained for the duration of the subscription.
Newsletter-only signups (non-paying): retained until you unsubscribe or request deletion.
5. Who We Share Data With
The Author does not sell, rent, or share your personal data with third parties for their marketing purposes. The following third-party processors are used:
Patreon, Inc. (USA): Merchant of Record, payment processing and global tax (VAT/GST/sales tax) collection and remittance, membership management, and the reading platform on which episodes are delivered. Patreon's own privacy policy governs the data it processes.
Hostinger International Ltd (EU): hosting of the gateway website at notyetmemoir.com.
Data transfers to the USA are conducted under Standard Contractual Clauses (SCCs) or equivalent mechanisms as required by GDPR Chapter V. By subscribing, you acknowledge that your data may be transferred to and processed in the United States.
6. Your Rights Under GDPR
If you are located in the European Economic Area (EEA), UK, or Switzerland, you have the rights of access, rectification, erasure, restriction, data portability, objection, and withdrawal of consent. To exercise any of these, email inquiries@notyetmemoir.com; we respond within 30 days. You may also lodge a complaint with your national data protection authority.
7. EU and UK Representative (Article 27)
As a controller established outside the EU/EEA and the UK that offers content to data subjects there, the Author will appoint a representative pursuant to Article 27 of the EU GDPR and the UK GDPR. Once appointed, the representative's contact details will be published at notyetmemoir.com/legal, where EU/EEA and UK data subjects may contact them.
8. COPPA - Children's Privacy
The Author does not knowingly collect personal data from children under 13. The Publication is intended for a general adult readership and contains mature, non-explicit themes. If it becomes known that data has been collected from a person under 13, it will be deleted immediately in accordance with the FTC Children's Online Privacy Protection Rule (COPPA Rule, as amended 2025) and the FTC Age Verification Policy Statement (2026).
9. California Residents - CCPA Rights
If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected, the right to delete it, and the right to opt out of its sale. The Author does not sell personal information. To exercise your CCPA rights, contact inquiries@notyetmemoir.com.
10. Security
The Author takes reasonable technical and organisational measures to protect your personal data against unauthorised access, loss, or disclosure, including HTTPS encryption on notyetmemoir.com, reliance on the Merchant of Record's (Patreon's) PCI-DSS compliant payment infrastructure, and limiting access to subscriber data. No method of transmission over the internet is 100% secure.
11. Cookies
notyetmemoir.com uses only essential cookies necessary for site operation. No advertising or tracking cookies are used. The reading platform (currently Patreon) may set its own cookies when you access your membership - please refer to Patreon's cookie policy. You may disable cookies in your browser settings, though this may affect site functionality.
12. Links to Third Parties
The Publication contains affiliate links to third-party services (Booking.com, Airbnb, GetYourGuide, airlines, etc.). The Author is not responsible for the privacy practices of these third parties. Please review their privacy policies before making any booking or purchase.
13. Privacy Compliance - Jurisdictions Covered
The Author has made every reasonable effort to comply with applicable privacy laws in the countries described in the memoir, including the European Union (GDPR), Belgium (the author's country of citizenship), Colombia, Panama (the author's country of residence), Mexico, Thailand, Vietnam, Cambodia, and the United States (FTC rules, CCPA, COPPA). Any person who believes their privacy has been affected by the content of this publication is invited to contact inquiries@notyetmemoir.com directly so that the matter may be addressed.
14. Changes to This Policy
This Privacy Policy may be updated from time to time. When changes are made, the effective date will be updated and active subscribers will be notified by email at least 14 days before material changes take effect. Continued use of the Publication after the effective date constitutes acceptance of the updated policy.
