Preamble
These Terms & Conditions (the “Agreement”) govern your access to and use of all content, recurring subscription plans, digital products, standalone guides, and one-off episode packages featuring the memoir Not Yet, written and published by Frank Segers (the “Author” or “Publisher”), via the gateway website at notyetmemoir.com and our authorised Merchant of Record and reading platform (currently Patreon). By subscribing to, purchasing, or accessing the Publication, you agree to these Terms.
1. Mature Themes and Reader Discretion
The Publication is intended for a general adult readership. By subscribing or purchasing, you confirm that you have reached the age of majority required to form a binding contract in your jurisdiction. The Author reserves the right to decline, suspend, or terminate access where a user is not legally able to enter into this Agreement.
2. Nature of Content - Creative Non-Fiction
Not Yet is a work of creative non-fiction recounting the author's travels and experiences from 2023 onward. Names, identifying details, dialogue, and the sequence or timing of events may be changed, compressed, fictionalised, or reconstructed for narrative clarity and to protect the privacy of individuals. Characters may be composites, and any resemblance arising from such changes is not intended to identify real individuals.
The complete Front-Matter Disclaimer that opens the memoir - covering the creative non-fiction nature of the work, photographs and media, the mature-themes advisory and reader discretion, privacy compliance, affiliate disclosure, and intellectual property - is published on the Disclaimer page and forms part of these Terms, incorporated by reference.
3. Subscriptions and Purchases
3.1 Plans and Products
Free preview - a selection of episodes available at no charge.
Monthly subscription - recurring access to the Publication.
Annual subscription - recurring annual access to the Publication.
Ambassador - one-time lifetime access, including the Nomad's Toolkit, offered during designated periods.
Season Bundles - one-off purchases of a curated set of episodes.
The Nomad's Toolkit - a standalone companion product.
Current prices for all plans and products are shown at notyetmemoir.com and are not reproduced in these Terms. Prices may change from time to time as set out below.
3.2 Billing, Merchant of Record, and Auto-Renewal
All payment transactions are securely processed by our Merchant of Record (currently Patreon), which acts as the seller of record for the transaction and calculates, collects, and remits applicable sales tax, VAT, and GST on the Author's behalf based on your location at checkout. The Merchant of Record acts solely as the seller of record for the commercial transaction and holds no editorial, authorial, or ownership rights in the Publication, all of which remain exclusively with the Author. The charge on your statement will appear under a descriptor associated with the Merchant of Record. Recurring plans renew automatically until cancellation, in compliance with the FTC Negative Option Rule and the Restore Online Shoppers' Confidence Act (ROSCA). Renewal terms are disclosed at the point of purchase and in your confirmation email. The Author is not responsible for bank fees or foreign-exchange charges imposed by your financial institution.
3.3 Cancellation
You may cancel at any time through your account settings or by contacting inquiries@notyetmemoir.com. Cancellation takes effect at the end of the current billing period; access is retained until then.
3.4 Refunds
Digital content is non-refundable once accessed. For EU and UK subscribers, by accessing the content immediately you acknowledge the loss of the right of withdrawal in accordance with EU Directive 2011/83/EU Article 16(m). Exceptions for a genuine billing error may be considered at our sole discretion if you contact inquiries@notyetmemoir.com within 7 days of the charge.
3.5 Publishing Schedule
New episodes are published on a regular fortnightly cadence. The schedule may occasionally vary, and access is to the Publication rather than to a guaranteed number of episodes in any period.
3.6 Price Changes
Prices may change from time to time. Existing subscribers will be given at least 30 days' notice before any change affecting their plan, and changes apply from the next billing cycle.
3.7 Founding Price Lock
Subscribers who join during a designated founding or launch period retain their locked-in rate for as long as their subscription remains active and uninterrupted. Founding status is personal and non-transferable.
3.8 Promotional Pricing
Promotional or bundle prices are offered for limited periods and revert to standard pricing afterwards.
3.9 Third-Party Platforms and Their Terms
You may access the Publication through third-party platforms, currently Patreon. Those platforms operate under their own terms, and by using a platform you agree to that platform's terms, which govern your relationship with it, including your account, payment, billing, refunds, and conduct on the platform. These Terms govern the Publication itself and your relationship with the Author. Where these Terms conflict with a platform's terms as to that platform's own services, the platform's terms control for those services, consistent with clause 12.3, while these Terms continue to govern the Publication and your relationship with the Author. Nothing in these Terms limits or removes any right or obligation you have under the applicable platform's terms.
3.10 Lifetime and One-Time Access Across Platforms
Certain offerings, including the Ambassador, the Grand Tour, and one-time episode or collection purchases, grant access described as lifetime or one-time. This access is provided through the platform on which you bought it and depends on that platform continuing to make the Publication available. If the Author stops using a platform or moves to another, the Author will use reasonable efforts to give holders of lifetime or one-time access equivalent access to the same content on a successor platform, at no further charge. Access may still be interrupted or ended for reasons outside the Author's control, including a platform's own decisions.
4. Intellectual Property
All content - text episodes, photographs, video and audio recordings (including short-form social video), graphics, branding, and web design - is the exclusive property of Frank Segers, protected under international copyright law. Photographs and video are treated identically for copyright, consent, and permitted use. You receive a personal, non-exclusive, non-transferable, revocable licence for private, non-commercial reading only. You may not reproduce, redistribute, screen-record, or create derivative works, use the content to train or prompt AI or machine-learning systems, remove watermarks or copyright notices, or share your login or access links with non-purchasers.
5. Privacy and Data Protection
User data is handled in accordance with our Privacy Policy, the EU and UK GDPR, and the FTC COPPA Rule where applicable.
6. Commercial Affiliate Disclosure
Pursuant to FTC guidelines (16 C.F.R. Part 255), episodes may contain affiliate links to travel platforms (including Booking.com, Airbnb, GetYourGuide, and various airlines). If you purchase through these links, the Author may earn a small commission at no extra cost to you.
7. User Conduct and Comment Moderation
If you participate in comments or community discussion, you agree not to post abusive, threatening, defamatory, harassing, or spam content. The Author retains absolute discretion to delete comments, ban users, and terminate access without refund for repeated misconduct.
8. Assignment, Right to Incorporate, and Succession
The Author reserves the absolute and unrestricted right to assign, transfer, sell, or delegate his rights, domain and platform properties, content archives, and all active reader memberships and obligations under this Agreement to a limited liability company (in any jurisdiction), corporate entity, estate, or designated third party at any time without requiring individual user consent, provided that content access for existing paid users remains uncompromised. Upon any such assignment, the successor shall succeed to the rights and assume the operational responsibilities of the Author. In the event of the death or incapacity of the Author, this Agreement remains binding and inures to the benefit of his chosen successors, executors, or heirs.
9. Disclaimer of Warranties and Reader Responsibility
All content is provided strictly on an “as is” and “as available” basis, without warranties of any kind. Nothing in the Publication constitutes professional legal, financial, medical, intellectual-property, or travel-safety advice. The Publication recounts the personal experiences and opinions of the Author and may describe routes, destinations, accommodation, transport, food and drink, border crossings, activities, products, and services, including in 'The Nomad's Toolkit'. Any such description is a personal account of what the Author did in his own circumstances at a particular time, and is not a recommendation, instruction, endorsement, or assurance of safety, suitability, legality, or outcome for any other person. You are solely responsible for your own decisions, must exercise your own independent judgement, and should seek qualified professional advice where appropriate. You voluntarily assume all risks arising from any decision you make in reliance on the Publication and, to the fullest extent permitted by law, release the Author from any liability for personal injury, accident, illness, death, loss, theft, property damage, financial loss, or other harm.
10. Limitation of Liability
To the fullest extent permitted by law, the Author's total aggregate liability to any subscriber or purchaser for any claim arising out of or in connection with this Agreement or the Publication shall not exceed the total amount paid by that user in the twelve (12) months immediately preceding the claim. The Author shall not be liable for indirect, consequential, incidental, special, or punitive damages, including loss of revenue or emotional-distress claims.
11. Indemnification
You agree to indemnify and hold harmless the Author and his platform administrators from third-party claims, liabilities, damages, losses, and legal costs arising from your breach of this Agreement, your violation of any applicable law, or any content you post within our interactive spaces.
12. Hybrid Governing Law, Private Arbitration, and Dispute Resolution
12.1 Governing Law
This Agreement, the publication of content, and any non-contractual or tort claims (including privacy, defamation, copyright, or emotional-distress claims) arising from the memoir narrative are governed exclusively by the substantive laws of the Republic of Panama, without regard to conflict-of-law principles.
12.2 Mandatory Private Arbitration
Any dispute relating to the content, its formation, or alleged breach shall first be submitted to good-faith negotiation. If unresolved within thirty (30) days, it shall be finally resolved by binding, confidential private arbitration in Panama City, Panama, in English, on an individual basis only. To the fullest extent permitted by law, you and the Author waive any right to a jury trial and to participate in any class or collective proceeding.
12.3 Merchant of Record Billing Exception
For routine billing, transactional, automatic-renewal, or payment-processing matters arising at checkout, the terms of use and refund processes of our Merchant of Record apply, and such matters are administered by the Merchant of Record under its own terms and designated jurisdiction.
12.4 Consumer Protection Carve-Out
For EU and UK subscribers, nothing in this clause removes your mandatory statutory consumer-protection rights under your local national law, including recourse to your local courts or mechanisms where required.
12.5 Injunctive Relief
Notwithstanding the foregoing, the Author may seek urgent injunctive or equitable relief in any court of competent jurisdiction to protect his intellectual property, confidential information, or other rights.
13. Severability and General Provisions
If any provision of these Terms is held unenforceable, conflicts with the terms of a platform through which you access the Publication, or conflicts with applicable law, that provision is limited or removed to the minimum extent necessary, and the remaining provisions stay in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Author regarding the Publication.
The Author may update these Terms from time to time, for example to reflect changes in the law, to correct an error, or to introduce a new policy. When changes are made, the version published at notyetmemoir.com is the current one, and active subscribers will be notified by email at least 14 days before any material change takes effect. Continued use of the Publication after that date constitutes acceptance of the updated Terms.
Language and translation. This Agreement and the Publication are written and published in English, which is the original and authoritative version. Readers may choose to view the website, the Publication, or these Terms in another language using their own web browser's built-in translation or a similar tool. Any such translation is generated by the reader's own browser or device, not by the Author, and may contain inaccuracies or errors of meaning. To the fullest extent permitted by law, the Author accepts no responsibility or liability for any translated version, and in the event of any discrepancy the English text prevails.
